These General Terms and Conditions (\"GTC\") of FishSnap (\"FishSnap\") serve as the legal basis for the use of the services offered by FishSnap for private users (\"Services\").
FishSnap does not require the creation of a user account. All basic functions of the app can be used without registration.
FishSnap provides the user with access to the Services via the Internet (App) for the duration of the contractual relationship. FishSnap sets up the Services on one of its servers, which is accessible to the user via the Internet. FishSnap is only responsible for the availability of the Services on its own servers. The user is responsible for providing a suitable end device and a sufficient Internet connection. The user is also obliged to report any defects to FishSnap without delay.
FishSnap is the rights holder of the provided app and the content in the app. FishSnap grants the user a non-exclusive, non-transferable right, limited to the contract period, to use the Services via the app as intended and only for their own purposes. The user may only duplicate the app to the extent necessary for its intended use. The user is entitled to store the app on their mobile device in order to be able to use the app as intended.
Users can also purchase paid services from FishSnap (\"Pro Access\"). The essential features of the various paid services, as well as their contract duration, costs (both monthly and total), and termination options, are set out in our offers in the app. The order is placed via the button \"Subscribe with payment obligation\". The contract is concluded as soon as FishSnap accepts the order. The defect liability law for digital products applies to the paid services offered. The provision of the paid services takes place at the latest within three days after ordering the respective paid service.
The user has the right to withdraw from the contract regarding the paid services within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract. To exercise the right of withdrawal, the user must inform FishSnap of their decision to withdraw from this contract by an unequivocal statement (e.g. by e-mail). To meet the withdrawal deadline, it is sufficient for the user to send their communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. If the user withdraws from the contract regarding the paid services, FishSnap shall reimburse to the user all payments received from the user, without undue delay and in any event not later than 14 days from the day on which FishSnap is informed about the user's decision to withdraw from this contract. FishSnap will carry out such reimbursement using the same means of payment as the user used for the initial transaction, unless the user has expressly agreed otherwise; in any event, the user will not incur any fees as a result of such reimbursement. If the user has requested to begin the performance of the paid services during the withdrawal period, the user shall pay FishSnap an amount which is in proportion to what has been provided until the user has communicated to FishSnap the withdrawal from this contract, in comparison with the full coverage of the contract.
FishSnap's liability is unlimited in cases of malice, intent or gross negligence, within the scope of an expressly assumed guarantee, and for damages resulting from injury to life, body or health. For the breach of an essential contractual obligation, the parties are liable limited to the damage reasonably foreseeable at the time of conclusion of the contract, unless the conditions for unlimited liability are met. Otherwise, liability of the parties is excluded. The provisions of the Product Liability Act remain unaffected.
We reserve the right to change these GTC at any time. If we make changes, we will inform you about them. Continued use of the app after such notification means that you accept the amended GTC.
